Judge Clears Prescott of All Civil Claims in Sexual Assault Allegations
Months after Dallas police decided not to move forward with charges, a Collin County judge has now exonerated Dak Prescott of all civil claims relating to the sexual assault accusations against him. This development marks a significant chapter in a series of events that began in 2017.
The allegations surfaced back in 2017 when Prescott was accused of sexual assault. The accuser initially sought a staggering $100 million in exchange for not going to the police with the claims. However, in March, the accuser filed a report with the Dallas Police Department, prompting Prescott to respond by filing both a civil lawsuit and a criminal report against the accuser.
In an interesting turn of events, the accuser’s attorney dropped a Dallas County lawsuit in April, only to file a similar one in Collin County. The litigation saw significant movement in June when Judge Angela Tucker dismissed the accuser's claims, reinforcing Prescott’s stance.
The Dallas Police Department further cemented Prescott's position, concluding that there was insufficient evidence to support the allegations against him. "As we knew they would, they found nothing in their extensive exploration of the facts that would support a criminal prosecution," said Levi G. McCathern, Prescott's lawyer.
Prescott, confident in his defense, filed a civil lawsuit seeking over $1 million, citing extortion. The allegations took another dramatic turn when the accuser’s attorney sent a letter in January, indicating a willingness to drop criminal charges in exchange for $100 million. "The original lies by [the accuser], her team, and their recent failed attempt to sue him civilly are all just a continuation of their extortion plot against Dak," McCathern noted. He emphasized the detrimental impact of such ploys on genuine victims of sexual assault, stating, "These ploys distract from the trauma of legitimate sexual assault survivors and undermine the progress that our society has made in supporting them."
Despite the dismissal of civil claims, the legal saga continues. Prescott's and the accuser's lawsuits are still navigating the civil courts in Collin County. The accuser's motion for a "non-suit without prejudice" indicates that refiling the case in Dallas County remains a possibility. Prescott's team remains vigilant, confident in their defense. "I know the truth, I'm confident in what we filed, very confident in what we filed," Prescott asserted.
Prescott's lawyer, McCathern, expressed hope for future outcomes in the extortion case. "We are confident that at the end of law enforcement's investigation into the extortion case that they will find the accuser and her attorneys just as guilty as Dak is innocent."
The public attention towards this high-profile case has been intense, and for Prescott, it has added a layer of complexity to his life both on and off the field. Prescott, who is entering the final season of a four-year, $160 million contract in 2024, has managed to maintain his focus amidst the tumultuous events.
While the legal battles play out, Prescott remains empathetic towards survivors of sexual assault, with McCathern noting, "Mr. Prescott—a new father to a baby girl—has great empathy for survivors of sexual assault." He added, "To be clear, Mr. Prescott has never engaged in any nonconsensual, sexual conduct with anyone. Lies hurt. Especially, malicious lies. We will not allow the Defendant and her legal team to profit from this attempt to extort millions from Mr. Prescott."
